We may change, update, or replace these Terms at any time in our sole discretion by posting a revised version with a new "Last updated" date. Continued use of the Web- site after a revised version is posted constitutes acceptance. Review these Terms peri- odically. Material changes will be announced by a banner.

4. Eligibility and Age Requirements

The Website is intended for individuals 18 years of age or older. Some content ad- dresses substance use, overdose, self-harm, and trauma, and may not be appropriate for children.

  • Persons under 13 may not use the Website or submit any information through it.

  • Persons 13 to 17 are strongly encouraged to use the Website only with the knowledge and permission of a parent or legal guardian.

We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact us at doctorrogerwatts@gmail.com and we will delete it.

5. No Medical Advice; No Professional Relationship

All content on the Website is provided for general informational and educational purposes only.

  • Nothing on the Website is medical, psychological, psychiatric, nursing, counseling, legal, or other professional advice.

  • Nothing on the Website is intended to diagnose, treat, cure, or prevent any condition, and it must not be used as a substitute for evaluation by a qualified professional.

  • Using the Website, reading its content, submitting a form, or communicating with us does not create a clinician–patient, therapist–client, physician–patient, or other professional relationship between you and us or any person directly associated with the operation of this Website.

  • Always seek the advice of a physician, licensed clinician, or other qualified health provider with any question you have about a medical or behavioral- health condition. Never disregard professional advice or delay seeking it because of something you read on the Website.

  • Never start, stop, or change any medication — including medications for opioid use disorder, alcohol use disorder, or any co-occurring condition — based on Website content. Abrupt cessation of alcohol, benzodiazepines, or other substances can be medically dangerous or fatal; withdrawal should be medically supervised.

Reliance on any website content is solely at your own risk.

6. Screening Tools and Self-Assessments

The screening Checklist and Rating Scale tool on the Website is an educational aid only. It is not a diagnostic instrument, does not produce a diagnosis, and its results are not a clinical opinion. Results may be inaccurate or incomplete and must be interpreted by a qualified professional. We do not guarantee that any tool is validated for your age, population, language, or circumstances. Do not make any treatment decision based solely on a result from this Website.

7. No Guarantee of Results

Addiction, substance use disorder, and recovery outcomes vary enormously between individuals. We make no representation, warranty, or guarantee of any treatment outcome, recovery, abstinence, sobriety duration, symptom improvement, or other result.

Any testimonial, success story, statistic, outcome figure, or personal account appearing on the Website reflects an individual experience or a specific data set and is not typical, not predictive, and not a promise of similar results.

Descriptions of treatment programs that are references on the Website are general and are not a representation of the specific care you or a loved one will receive.

8. Directories, Referrals, and Third-Party Resources

Any listing, directory entry, referral, hotline, meeting, program, provider, or re- source identified on the Website is provided for informational convenience only and does not constitute an endorsement, recommendation, certification, or verification by us.

  • We do not independently verify the licensure, accreditation, credentials, insurance status, safety, quality, or current availability of any listed provider or resource.

  • You are solely responsible for evaluating any provider or resource before engaging with it, including verifying licensure with the applicable state or national authority.

  • We are not a party to and have no responsibility for any relationship, agreement, treatment, or transaction between you and any third party.

9. Third-Party Links

The Website may link to websites we do not control. We provide links for convenience only, do not endorse the linked sites, and are not responsible for their content, accuracy, privacy practices, terms, or business practices. Your use of any linked site is governed by that site's own terms and is entirely at your own risk.

10. Privacy, Confidentiality, and Sensitive Information

Our collection and use of information is described in our Privacy Policy.

  • Do not send us protected health information, treatment history, diagnoses, substance use details, or other sensitive information through the Website, email, or text.

  • Submitting information through the Website does not create a treating relationship and does not place that information under [HIPAA / 42 CFR Part 2] protection unless a separate protected relationship exists.

11. User Content and Community Rules

"User Content" means anything you post, upload, or submit to the Website.

By submitting User Content in any form, you grant us a perpetual, worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to use, host, store, reproduce, modify, adapt, publish, translate, distribute, and display it in any media, without compensation. • Collect other users' contact information or contact other users off-platform for commercial purposes.

  • Upload malicious code, scrape the Website by automated means, or inter- fere with its operation.

14. Disclaimer of Warranties

The website and all content are provided "As is" and "As available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.

We do not warrant that the Website will be uninterrupted, secure, timely, error- free, or free of viruses, or that content is accurate, complete, current, or suitable for your circumstances. Screening guidance changes; content may become out of date. You are responsible for your own virus protection and data backup. We may modify, suspend, or discontinue the Website or any part of it at any time without notice.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, neither we nor our affiliates, officers, directors, employees, contractors, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or pu- nitive damages, or for lost profits, lost data, business interruption, personal injury, emotional distress, or wrongful death, arising from or relating to your use of or inability to use the website or any con- tent, whether based in contract, warranty, negligence, strict liability, or any other theory, even if advised of the possibility.

Our total aggregate liability for all claims relating to the web- site will not exceed $129 or the amount you paid us in the 12 months preceding the claim.

Before pursuing any legal remedy, you must notify us in writing at doctorrogerwatts@gmail.com and allow thirty (30) days to cure. Any claim must be filed within one (1) year after it arises, or it is permanently barred.

Binding arbitration. Any dispute arising out of or relating to these Terms or the Website that is not resolved informally will be settled by final and binding arbitration before one arbitrator, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Hennepin County, Minnesota. The arbitrator will issue a reasoned written award. Judgment may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring an individual action in small claims court, seek injunctive relief for intellectual-property misuse, or pursue relief through an applicable government agency.

If this Section is found unenforceable in whole, the governing-law and venue pro- visions in Section 19 control.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Minnesota in the United States of America, without regard to conflict-of-laws rules.
